(What Publishers Do Not Want Churches and Schools To Know.)
INTRODUCTION
When you read the copyright notices placed on church music, you get the feeling that if the music is copied, a terrible crime has been committed. Publishers are now making it blatantly obvious that they also are working to scare anyone from copying scripture from the Bible. Publishers of the NIV Bible most recently are advocating the non-copying of excerpts from its version. This information is for educational purposes to get a clearer understanding of copying material for worship and educational purposes. Many so called experts in interpreting the copyright laws have printed reports made available to religious organizations and educational institutions. A majority of the reports seek to address outlines for use or are just legal experts with the publishing company's interest in mind. After all, the Baptists, i.e. just to name one denomination, are insured for $4 million per copyright infringement of their publications. That's quit an expense and of course the premiums have to be paid through sales. Sales; now that is the primary basis for the scare tactics publishers use.
COPYRIGHT LAW
The exclusive rights in copyrighted works are granted in section 17 USC §106 of the United States Code entitled "Copyrights." These exclusive rights are subject to sections 107 through 118.
Comment
It is section §106 that the publishers base their scare tactics aimed at telling the churches and schools that they in no way or at any time may copy their published material. These statements by the publishers are not in accordance to the copyright law. The very first paragraph of section §106 clearly states that the owner of copyright is subject to sections 107 through 118.
§107. Limitations on exclusive rights: Fair Use
Notwithstanding the provisions of section 106, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include -
