W.M.) He devised: To wife, the use, occupancy and enjoyment of my dwelling house with garden and appurtenances; also 1,000 acres of my land, which I purchased of Walter Story Chandler and Benjamin Oden, called Hepburn Land, supposed to contain between seven and eight hundred acres and any land adjoining to make up the 1,000 acres, during her natural life; also sheep, cattle, carriage and horses etc; 1/3 of all negroes, plate and household furniture. To son Dr. William Hill, all that tract of land consisting of many small tracts, all of which have names as marked on a plat made for me by John Robinson on the 6th Feb, 1806 and upon the death of my wife I give the 1,000 acres to him in fee simple provided he dies leaving a lawful issue; otherwise, I give and devise the lands to son Charles upon the same terms; should he die without leaving issue to son John- meaning to create only a conditional estate… I give to son Charles, tract at Seneca, Montgomery County, conditionally… I give to son John, tract in The Forest, Spy Park, inherited from my father.
