Jamison, deceased, and we. Mrs. Ella Neiter Proctor, Robert Chalmers Jamison, Mrs. Elizabeth Knox Gillespie and Mrs. Laura Lee Brice, being the children of the said I.N. Jamison, deceased, and the sole legatees (except for the few small legacies hereinafter stated)and the sole legatees under the terms of his last Will and Testament of date, 24th September, 1903, and duly probated on the 12th of August, 1908, in the office of the Probate Court for the said County and State, desire to divide between ourselves the personal property devised and willed to us by the said I.N. Jamison, and, WHEREAS, by the terms of the said will it was provided that his widow should have a life estate in the said personal property, and that at her death the said personal property should be divided equally between the four children above mentioned, share and share alike, and should any one or more of the said named children die without children before the division, then the share of the one so dying should go to the survivor or survivors, and, WHEREAS, there is also provided in the said Will for the payment of a small legacy of One Dollar each to Joseph Marion Jamison, and the children of Melissa Ann Brown, and there being three such children. And, WHEREAS, all of the children first named herein are now of age, and it is considered to the interest of all that the personal property to which they are entitled be now divided equally among them, and , whereas, the widow consents to this division, and desires the same in her own behalf and in behalf of the said children. NOW, know all men by these present that we, the said Sarah Pauline Jamison, Ella Neiter Proctor, Robert Chalmers Jamison, Elizabeth Knox Gillespie, and Laurie Lee Brice, do hereby contract and covenant and mutually agree with one another that all the personal estate of which the said I.N. Jamison died seized and possessed after the payment of his just debts, funeral expenses all the personal estate of which the said I. N. Jamison died seized and possessed after the payment of his just debts, funeral expenses, costs of administration of his estate, and probate fees, and the other small legacies provided in the said will, and the commissions due the executor appointed in his said Will, and any other legitimate expense of the said estate, shall be and hereby is divided in equal shares, share and share alike, between each of us, so that we each shall take a one-fifth thereof, and that the share taken by each of the parties hereto shall be taken and help absolutely, freed from all limitations and restrictions, and we do further agree and obligate and bind ourselves to divide the said personal property at once, and that we do further agree that the Executor named in the Will of I. N. Jamison, deceased, Mr. John J.McDaniel, shall be and hereby is authorized, empowered, requested and directed to pay over to each of us a One-Fifth of the personal property of the said estate, as aforesaid, in full settlement, release and discharge of all liability on his part as Executor, and that the receipt of the party to whom the money is paid shall be take and accepted by him in full discharge of his liability therefore, and it is further agreed and understood that this division of the personal property is made absolutely, and that neither of the children shall make any claim upon the interest or share of the other, in case he or she should die without children, and it is also agreed that the widow relinquishes and releases all of her life estate in the said personal property, as provided in the said Will, and accepts and receives a one-fifth interest therein absolutely in lieu of her life estate in the entire fund, and it is expressly desired and understood that the Executor of the Will of I.N. Jamison, deceased, shall make this division as soon a convenient, and that the same is made in conformity and in compliance with the terms of the said Will, and is simply made at the present for the mutual benefit of us all, and not for the purpose of defeating or destroying or interfering with the terms of said Will.
