Only an activist court could have ruled differently prior to the thirteenth amendment in 1865. In contrast, Dworkin has argued that the "strict construction" view is inconsistant with the court's interpretive role. Here, Ely describes a middle ground. The Essential Holmes : Selections from the Letters, Speeches, Judicial Opinions, and Other Writings of Oliver Wendell Holmes, Jr.Holmes was more or less universally admired. No mean trick in pre-Civil War America. | ||||||
